The quality of the expert evidence adduced in support of a claim will have an impact on the outcome and the level of damages. Experts are required to a lesser or greater extent to support all personal injury cases. They provide medical reports, rehabilitation reports, accident reconstruction reports, locus reports and plans, engineer’s reports and accountant’s reports. Because we are a specialist firm and have longstanding expertise, we have built up a professional working relationship with the experts we instruct.
We should mention that the conduct of experts engaged in litigation is governed by the Civil Procedure Rules. Their primary duty is to assist the courts and they are obliged to be objective.
Local Experts to Assist your Claim
We prefer to instruct local experts who we know are reliable, professional and have a good track record. However, if necessary we have available a national database of approved experts.
The value of your claim will depend upon the extent and duration of your medical symptoms and the resulting financial losses. This is assessed upon the expert evidence disclosed in support of your case. In accordance with the personal injury protocol we will be obliged to invite the defendant’s insurer to agree the instruction of a medical expert. We provide a list of preferred experts and then arrange for you to see a consultant or other appropriate medical expert.
The correct Level of Compensation
We do not rush cases. Personal injury cases are assessed on a once and for all basis and it is important to us to achieve the correct level of compensation and not settle too soon. We rely upon the quality of our medical experts to give guidance with regard to the future prognosis so we can assess the appropriate time to settle.
Sometimes more than one medical report will be required from the same expert. This may cause a delay in settlement but will ensure that you are fully and properly compensated.
